Who we are

Durst Industries (Aust.) Pty Ltd is an Australian manufacturer of auto-electrical equipment — including jump starters, battery chargers, load testers, test benches and related industrial products — proudly manufacturing in Australia since 1918. Our website address is https://durst.com.au.

The personal information we collect

When we use the term “personal information”, we mean information that identifies, or could reasonably be linked to, you or another person. It does not include information that is anonymous or has been de-identified so that it cannot reasonably be linked back to you.

Depending on how you interact with the Services, we may collect or process the following categories of personal information, including inferences drawn from it:

  • Contact details — your name, billing and shipping address, phone number and email address.

  • Financial information — payment card details, financial account information, transaction details, form of payment and payment confirmations. (Payment card data is handled by our payment providers through secure gateways; see How we protect your information below.)

  • Account information — your username, password, preferences and settings.

  • Transaction information — items you view, add to your cart or wishlist, purchase, return, exchange or cancel, and your past transactions.

  • Communications — the information you include when you contact us, for example a customer-support enquiry, a product review, a repair or warranty request, or a newsletter sign-up.

  • Device and technical information — your device, browser and network connection, your IP address, and other unique identifiers.

  • Usage information — how and when you interact with and navigate the Services.

You do not have to provide us with personal information, but if you choose not to, we may not be able to provide you with some or all of the Services (for example, we cannot fulfil an order without shipping and payment details).

How we collect your personal information

We may collect personal information:

  • Directly from you — when you create an account, place an order, contact us, leave a review, request a repair or otherwise provide information to us.

  • Automatically — from your device when you use the Services, including through cookies and similar technologies.

  • From our service providers — such as our e-commerce platform, payment processors and analytics providers, when they collect or process information on our behalf.

  • From our partners and other third parties — such as distributors, marketing partners and shipping providers.

Cookies and similar technologies

We use cookies and similar technologies to operate and secure the Services, remember your preferences, understand how the Services are used, and support marketing. These include:

  • Essential cookies required for core functionality such as your cart, checkout and account login.

  • Preference cookies that remember choices such as language and display settings.

  • Analytics cookies that help us understand site usage and improve the Services.

  • Marketing cookies that support relevant advertising, where enabled.

Some cookies are set by us and some by third parties providing services on our behalf. You can control or disable cookies through your browser settings, though some parts of the Services may not function properly without them.

How we use your personal information

Depending on how you interact with us, we may use your personal information to:

  • Provide, tailor and improve the Services — perform our contract with you, process payments, fulfil and ship orders, manage returns, exchanges and repairs, create and maintain your account, remember your preferences, enable reviews, recommend relevant products, and improve the Services.

  • Communicate with you — provide customer support, respond to enquiries, and maintain our business relationship with you.

  • Marketing and promotions — send you marketing communications by email, SMS or post, and show you relevant advertising, where you have not opted out and as permitted by law.

  • Security and fraud prevention — authenticate your account, provide a secure payment and shopping experience, and detect, investigate and act on fraudulent, illegal, unsafe or malicious activity.

  • Comply with our legal obligations — meet applicable laws, respond to valid legal process and requests from law enforcement or government agencies, and enforce or investigate potential breaches of our terms or policies.

If you register an account, you are responsible for keeping your login credentials secure. We recommend you do not share your username or password with anyone.

How we disclose your personal information

We may disclose your personal information to third parties for legitimate purposes, subject to this Privacy Policy, including:

  • Service providers who perform functions on our behalf — such as our e-commerce platform, payment processing, IT and hosting, data analytics, customer support, cloud storage, fulfilment and shipping.

  • Marketing and advertising partners who help us promote and advertise the Services, in accordance with their own privacy notices. Depending on where you live, you may have the right to opt out of your information being shared for targeted advertising.

  • At your direction or with your consent — for example, to ship your products, or through your use of social media or login integrations.

  • Distributors and affiliates within our corporate and distribution network.

  • In connection with a business transaction such as a merger, acquisition or insolvency, or to comply with legal obligations, enforce our terms, or protect our rights and the rights of others.

We do not sell your personal information.

Our e-commerce platform

The online store is hosted by our e-commerce platform provider, which collects and processes personal information about your access to and use of the store in order to provide and improve it. Information you submit through the store may be transmitted to and shared with the platform provider and third parties, which may be located in countries other than where you reside, in order to provide and improve the Services.

To help protect, grow and improve our business, we may use platform features that incorporate data from your interactions with our store, along with data from other merchants and from the platform. Where the platform provider processes your personal information for these purposes, it is responsible for that processing, including for responding to requests to exercise your rights. You can review the platform provider’s own privacy policy for more information about how it uses your personal information and the rights you may have.

Analytics

We use analytics tools, including Google Analytics, to understand how visitors use and are referred to our website so that we can improve it. Only Durst employees and contractors have access to this data, and we use it solely for our own website improvement.

Third-party websites and embedded content

The Services may contain links to, or embedded content from, websites and platforms operated by third parties (for example, videos, images or articles). Embedded content behaves as though you had visited the third-party site directly, and those sites may collect data about you, set cookies and monitor your interaction with that content.

If you follow links to sites we do not control, you should review their privacy and security policies. We are not responsible for the privacy practices or content of third-party sites, and our inclusion of a link does not imply endorsement.

Children’s data

The Services are not intended for children, and we do not knowingly collect personal information from children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, please contact us using the details below and we will delete it.

How we protect and retain your information

We use industry-standard website security measures and monitor for attempts to breach our systems. All online payments are processed through secure payment gateways, and we do not store full payment card details ourselves.

Please be aware that no security measures are perfect or impenetrable, and information transmitted over the internet cannot be guaranteed to be completely secure. We recommend you do not use unsecured channels to send us sensitive or confidential information.

How long we retain your personal information depends on why we collected it — for example, whether we need it to maintain your account, provide the Services, comply with legal or tax obligations, resolve disputes, or enforce our contracts and policies. When we no longer need it, we take reasonable steps to destroy or de-identify it.

Your rights and choices

Under the Australian Privacy Principles, and depending on your circumstances, you may have some or all of the following rights in relation to your personal information. These rights are not absolute and may not apply in every case.

  • Access — request access to the personal information we hold about you.

  • Correction — request that we correct inaccurate or out-of-date personal information.

  • Deletion — request that we delete personal information we hold about you, subject to information we are required to keep for legal, administrative or security reasons.

  • Portability — request a copy of certain information you have provided to us.

  • Marketing preferences — opt out of marketing communications at any time using the unsubscribe link in our emails or by contacting us. If you opt out, we may still send you non-promotional messages about your account or orders.

To exercise any of these rights, contact us using the details below. We may need to verify your identity before actioning your request, and we may decline a request where permitted by law. You may also nominate an authorised agent to make a request on your behalf, subject to us verifying their authority. We will not discriminate against you for exercising your rights, and we will respond within the timeframes required by law.

International transfers

We may transfer, store and process your personal information outside Australia, including through our service providers and, where relevant, our international distributors. Where we transfer personal information overseas, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles and, where applicable, other recognised transfer mechanisms.

Complaints

If you have a complaint about how we handle your personal information, please contact us using the details below and we will investigate and respond. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for operational, legal or regulatory reasons. We will post the revised policy on this website, update the “Last updated” date, and provide any notice required by law.
